However, due to the nature of the internet and computer systems, no liability is assumed for permanent availability. Access may be restricted or suspended at any time due to maintenance work, capacity limits, security updates, or events beyond DALOG’s control (Force Majeure).

8.1. Intent and Gross Negligence: DALOG is liable without limitation for damages caused by intent or gross negligence, as well as for injury to life, limb, or health, and for claims under the German Product Liability Act (Produkthaftungsgesetz).
8.2. Slight Negligence: In cases of slight negligence, DALOG is only liable for the breach of essential contractual obligations (cardinal duties). Cardinal duties are those whose fulfillment is essential for the proper execution of the contract and on whose observance the user may regularly rely. In this case, liability is limited to the foreseeable, typically occurring damage. Liability for slight negligence regarding other obligations is excluded.
8.3. Loss of Data: Liability for the loss of data is limited to the typical recovery effort that would have occurred if regular and risk-adequate backup copies had been made by the user. It is the user’s responsibility to back up their own data regularly.
8.4. No Strict Liability: Strict liability for initial defects in the provided content or software (guarantee liability without fault) is excluded unless the defect was fraudulently concealed.
8.5. Free Services: Since the services and information on the public areas of the Website are largely provided free of charge, any liability for material defects and defects of title is excluded, except in cases of fraudulent concealment of a defect or intent.

10.2. Applicable Law: These Terms of Use and the entire legal relationship between the user and DALOG shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict of law rules.
10.3. Place of Jurisdiction: The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms of Use is Augsburg, Germany, provided the user is a merchant, a legal entity under public law, or a special fund under public law. DALOG is, however, also entitled to take legal action at the user’s general place of jurisdiction.
10.4. Written Form: Amendments or additions to these Terms of Use must be made in writing. This also applies to the waiver of the written form requirement.
10.5. Severability Clause: Should individual provisions of these Terms of Use be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
